  • Geo-detecting visitor location to offer localized content — Legal basis: legitimate interest (Art. 6.1.f GDPR). You may object to this processing.
  • Complying with legal obligations — Legal basis: legal obligation (Art. 6.1.c GDPR).

3. Categories of Personal Data

Identification data: name, company name.

Contact data: email address, phone number (if provided via WhatsApp).

Professional data: company size, project description.

Technical data: IP address, browser type, operating system, access logs.

4. Recipients

We do not sell your personal data. Data may be shared with:

  • Cloudflare, Inc. (US) — website hosting, security (WAF), and analytics. Transfers under the EU-US Data Privacy Framework.
  • LLM API providers (e.g., OpenAI) — only when processing client data as part of contracted services, under explicit client instruction and Data Processing Agreements.
  • Competent public authorities when required by law.

5. International Transfers

Some processors are located outside the EEA (United States). Transfers are based on the EU-US Data Privacy Framework adequacy decision or Standard Contractual Clauses (SCCs) as appropriate. You may request a copy of the safeguards by contacting [email protected].

6. Retention Periods

  • Contact form inquiries: 2 years from last interaction.
  • Client contract data: 6 years (Código de Comercio, Art. 30).
  • Marketing consent records: until withdrawal + 1 year.
  • Technical access logs: 30 days.
  • Data blocked for potential legal claims: retained for the applicable statute of limitations period.

7. Your Rights

Under GDPR (Arts. 15–22) and LOPDGDD, you have the right to:

  • Access your personal data.
  • Rectify inaccurate data.
  • Request erasure ('right to be forgotten').
  • Request data portability.
  • Object to processing based on legitimate interest.
  • Request restriction of processing.
  • Not be subject to solely automated decisions, including profiling (Art. 22 GDPR).

8. Automated Decisions and Artificial Intelligence

We do not make solely automated decisions that produce legal or similarly significant effects (Art. 22 GDPR). All AI-assisted outputs are reviewed by a human before any consequential action is taken.

In compliance with the EU AI Act (Regulation 2024/1689, Art. 50), any AI system that interacts directly with users (e.g., chatbots) clearly discloses its artificial nature. You may request human review of any AI-generated output at any time.

We do not engage in prohibited AI practices under AI Act Title II, including social scoring, subliminal manipulation, or exploitation of vulnerabilities.

9. Security Measures

We implement appropriate technical and organizational measures to protect your data (Art. 32 GDPR), including: TLS 1.2+ encryption in transit, AES-256 encryption at rest, role-based access controls, multi-factor authentication, and regular security reviews.
